國民黨立委廖國棟提案修正《卸任總統副總統禮遇條例》，將「有損國家主權或發表損及國家尊嚴等言論及行為」增列為停止禮遇的條件，對此，民進黨立委林俊憲今（22）日在臉書反諷說，廖國棟提這個案，應該沒找前總統馬英九商量過，這根本是「馬英九條款」、「廖國棟就是想『衝康』馬英九吧」。

廖國棟在提案說明指出，我國曾有卸任元首到日本參拜靖國神社、卸任後大搞台獨等言論，令國人失望。卸任元首對外仍代表國家形象，發言受各方矚目，若公然喪權辱國，對國家傷害甚鉅，因此要追討禮遇返回國庫。

對此，林俊憲表示，看到這個提案，令人最好奇的一件事就是「不知道馬英九怎麼看這件事」。他說，馬英九面對大陸時自稱先生，馬習會時連國徽都沒了，甚至最近還發表「努力不讓大陸對統一絕望」這種「想被統」的言論，不只是有損國家尊嚴，簡直只差沒對大陸跪下去了。

林俊憲指出，「馬英九的言行，是否完全適用？廖委員這個提案，能不能稱之為馬英九條款？」
